RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT (“Agreement”)

I, the parent/guardian of ("Candidate") fully understand and acknowledge that I have voluntarily allowed the Candidate to play sports and baseball at Post Oak Little League, Inc. ("POLL"), Tanglewood Park, First Presbyterian Church and Pumpkin Park during any and all baseball and sports camps held during 2024 by Houston Sports Adventures, Sports Parties, LLC, Carter Ayers and hereby give my approval for the Candidate to participate in any and all activities (including, but not limited to, any and all practices, games, tryouts, instructions, warm-ups, spectating, use of facilities, special events, and/or meetings) including transportation to and from, or in connection with, such activities.

I FULLY UNDERSTAND, ACKNOWLEDGE AND AGREE THAT: (a) the Candidate's participation in any way in the baseball camp activities and my and my family's and our invited guest's presence, use of the facilities, and participation in any way in activities on POLL's premises and on the campus of: HISD's T.H. Rogers Alternative School at 5840 San Felipe, and other facilities used for activities including but not limited to Tanglewood Park (collectively the "Premises") may involve and expose any or all of us and our personal property to dangers, risks and hazards, both obvious and latent, both natural and man-made, that can cause destruction of personal property and PHYSICAL HARM, INCLUDING WITHOUT LIMITATION, SERIOUS BODILY INJURY, PERMANENT DISABILITY, PARALYSIS, AND DEATH (collectively "RISKS"); (b) protective equipment does not prevent all of these RISKS, and they cannot be eliminated completely; (c) these RISKS and dangers may be caused by my or the Candidate's own actions or inactions, the actions or inactions of others, the conditions in which activities take place, or the negligence of the Releasees named below; and (d) there may be other risks and dangers and social and economic losses either not known to me or not readily foreseeable.

In consideration of the Candidate being allowed to participate in any way in baseball camp activities and of my and my family's and our invited guest's permission to enter and use the Premises and participate in any way in activities on the Premises, I do HEREBY FULLY ACCEPT AND ASSUME FULL RESPONSIBILITY FOR ALL SUCH RISKS AND FOR ANY ASSOCIATED INJURIES, LOSSES, COSTS, AND DAMAGES, and I, on our own behalf, and on behalf of the Candidate, our heirs, family, next of kin, personal representatives and assigns DO FURTHER AGREE TO AND HEREBY WAIVE, RELEASE, ABSOLVE, COVENANT NOT TO SUE, AND AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS HOUSTON SPORTS ADVENTURES, SPORTS PARTIES, LLC, CARTER AYERS, REAGAN BUCKLEY, POLL, Post Oak Baseball Foundation, Little League Baseball, Inc., Houston Independent School District, YMCA of the Greater Houston Area, and their respective past and present officers, directors, managers, coaches, team moms, team dads, assistants, umpires, organizers, sponsors, volunteers, agents, groundskeepers, employees, persons transporting the Candidate to and from activities, and other league participants (collectively "Releasees") FROM AND AGAINST ANY AND ALL LIABILITY, LOSSES, DAMAGES, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION, SUITS IN EQUITY, OF WHATEVER KIND OR NATURE, COSTS AND EXPENSES, INCLUDING ATTORNEYS' FEES (collectively "Claims"), whatsoever arising out of or related in any way to any harm, loss, damage, injury, suffering, paralysis, death or property loss, that may be sustained by the Candidate, me, or my family arising out of or related in any way to the Candidate's participation in league activities and/or the Candidate’s and my family's and our invited guest's presence, use of the facilities, and other activities on the Premises, whether caused by, or alleged to be caused by, or the result of, in whole or in part, the negligence of the Candidate, me or my family, or THE NEGLIGENCE OF THE RELEASEES, INCLUDING NEGLIGENT RESCUE OPERATIONS, OR FROM ANY OTHER CAUSE. I further agree to indemnify and hold Releasees harmless from and against any and all Claims asserted against any of the Releasees by anyone else arising out of or related in any way to the Candidate's participation in league activities and/or the Candidate’s, my and my family's and our invited guest's presence, use of the facilities, and other activities on the Premises and/or Claims that occur as a result of the Candidate’s, my and my family's and our invited guest's negligent or intentional act or omission on the Premises or while participating in league activities or related activities.

I understand that my child should not participate unless medically able, and hereby certify that my child is in good physical condition, is fit to participate in any and all league activities and suffers from no physical impairment that might be aggravated by said participation. I certify that my child is covered by medical insurance. I understand and agree that Releasees are granted permission to authorize medical treatment, if necessary, for the Candidate and that such action by Releasees shall be subject to the terms of this Agreement. I understand and agree that Releasees assume no responsibility for any injury of damage to the Candidate or for any related cost which might arise out of or in connection with such authorized medical treatment, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE. I understand that I am strongly urged to obtain adequate health insurance to pay any medical costs that may be attendant as a result of injury to my child.

I agree that all photographic images, including but not limited to video recordings, film or digital photography, internet or web-cam streams, or other reproduction of my likeness or the likeness of the Candidate or my child(ren) during league activities or on the Premises, as well as sound or audio recordings, whether in tangible, electronic or other formats, may be used, reproduced, and displayed for entertainment, educational, promotional, and/or other reasonable purposes that will primarily benefit Houston Sports Adventures, Sports Parties, LLC, Carter Ayers, Reagan Buckley, and POLL, at no cost or charge to POLL, Little League Baseball, Inc., and/or their sponsors, promoters, event organizers, designees and/or assigns, including but not limited to use and display of such images and any accompanying audio on POLL's website, web cams directory and other league promotional materials. All such images, audio and other media shall be the exclusive property of POLL.

I agree that when parking for league activities, I am to park in only the areas on the Premises designated by POLL and/or T.H. Rogers Alternative School, that Releasees are not responsible for theft on the Premises or damage to my motor vehicles, and understand that I am encouraged to lock my car and park it in a place where it is not susceptible to being hit by baseballs.

I understand and agree that I and the Candidate must be watchful at all times while on the Premises for risks and hazards associated with league activities, including but not limited to, being hit and injured by errantly thrown balls, batted balls, or errantly swung bats or training aids and agree that Houston Sports Adventures, Sports Parties, LLC, Carter Ayers and POLL assume no liability for such risks and hazards. In addition, I understand and agree that I are expected to supervise any minors under my care at all times while on the Premises, and to protect them from risk of injury.

I (Player & Parents/Guardians) further agree to abide by all Houston Sports Adventures, Sports Parties, LLC, Carter Ayers, Reagan Buckley and POLL rules, including, without limitation, the rules found in the current version of the POLL Handbook available on POLL’s website, and agree to conduct ourselves in a sportsmanlike manner during league activities. I realize that violations of POLL rules are consequential and could result in ejections and/or suspension(s) from activities and from the Premises.

I (THE PARENTS AND GUARDIANS) OF THE CANDIDATE HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL OF THE FOREGOING PROVISIONS OF THE RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT, HAVE CHECKED ALL OF THE BOXES TO ACKNOWLEDGE OUR AGREEMENT, AND INTEND IN ALL RESPECTS THAT THE CANDIDATE AND I (WE) AND OUR FAMILY BE BOUND BY THEM. I FURTHER STATE THAT I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT TO ENTER THIS AGREEMENT, AND THAT I HAVE EXECUTED THIS AGREEMENT AS MY OWN FREE ACT AND DEED FOR FULL, ADEQUATE, AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY THE SAME. IT IS FURTHER MY EXPRESS INTENT THAT THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT SHALL BIND MYSELF, THE CANDIDATE, THE OTHER MEMBERS OF MY FAMILY AND SPOUSE, IF I AM ALIVE, AND MY ESTATE, FAMILY, HEIRS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, EXECUTORS, AND/OR ASSIGNS, IF I AM DECEASED. I FURTHER AGREE THAT THIS AGREEMENT SHALL BE INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. IF ANY TERM OR PROVISION OF THIS AGREEMENT SHALL BE DEEMED TO BE ILLEGAL, UNENFORCEABLE, OR IN CONFLICT WITH ANY LAW, THEN THE VALIDITY OF THE REMAINING PORTIONS OF THE AGREEMENT SHALL NOT BE AFFECTED THEREBY.

I acknowledge that I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT, understand its terms, and have executed it voluntarily with full knowledge of its significance on:
